I frequent this board alot but never really post but I had a question regarding the legal contracts. So we picked our donor shes an in house donor will be anonymous for the ivf clinic were using. We were given a breakdown of charges her 8k fee etc, so our lawyer sends us the first draft of the contract and asks us to look over so it can be sent to the donors lawyer. So my lawyer included the below in the contract and I was thinking of asking her to take it out because we were never told we had to pay for her gas, parking (which is free) or put money away for any kind of trust. Did any of you have to do that? I highlighted what I wanted taken out because the other stuff is the fee that ivf clinic told us about. I just feel like saying she can get paid for inconviences opens us up for a lot of bills from her for us. What would you do? We pay the whole 20k day 21 of her starting lupron, so shouldnt that be considered a trust for some of her services?
VIII. CONSIDERATION FOR SERVICES
The Parties agree that the consideration paid pursuant to this Agreement constitutes reasonable monetary compensation for all foreseen, and unforeseen losses, costs and expenses incurred, and services rendered by Donor in carrying out her obligations hereunder. Such consideration includes, but is not limited to mileage, parking, inconvenience, pain and suffering and for Donorâ€ââ€Â¢s assumption of all medical and psychological risks related to this Agreement. Donor is not selling her genetic material, nor is she being paid to relinquish her parental rights to any Children born from her genetic material. All of the following items shall be paid directly from a trust account to be funded in full prior to Ovum Retrieval.
